Abrego Garcia's attorneys filed the emergency motion in August, arguing that since he was deported to El Salvador and brought back to your domain name the United States, he is now eligible for asylum because his last entry to the United States was in the last year. In a copy of the decision obtained by ABC News, Regional Deputy Chief Immigration Judge Philip Taylor said that the motion was "untimely," because the motion was filed almost six years after his initial immigration proceedings. The deadline to apply for asylum is 90 days. The judge also said there was "insufficient evidence" that Abrego Garcia would be deported to another country by the Department of Homeland Security. In August, DHS told Abrego Garcia's attorneys that they might deport Abrego Garcia to Uganda, Eswatini, or another third-world country. Judge Taylor also found that the evidence Abrego Garcia provided in his motion for protection was "insufficient." Abrego Garcia had stated that he feared that the Salvadoran government would torture or kill him for being labeled as a member of the MS-13 gang. The judge said that while in El Salvador's CECOT check out here prison, Abrego Garcia did not experience "the conditions described in his country conditions evidence," and that while Abrego Garcia was at CECOT, he was not "specifically singled out" by the guards.
